When a loved one falls seriously ill or gets injured, it can be challenging to balance caregiving with work responsibilities. Fortunately, the New Jersey Family Leave Insurance program allows eligible workers to take job-protected leave while receiving partial wage replacement.

What is New Jersey Family Leave Insurance?

New Jersey's Paid Family Leave Act established the Family Leave Insurance (FLI) program to support employees who need to take time off to care for a seriously ill family member. The FLI program offers up to 12 weeks of paid leave, allowing employees to manage the care of close relatives such as parents, children, spouses, or domestic partners without the financial pressures of unpaid leave.

The program provides partial wage compensation through a state-run insurance fund and includes job protection, ensuring that employees can return to their positions after their leave period, similar to protections under the federal Family and Medical Leave Act (FMLA). This initiative significantly aids in balancing the emotional and physical demands of caregiving with financial stability.

Services covered under New Jersey Family Leave Insurance

  • Benefits for twelve consecutive weeks (84 days) in a 12-month period
  • Or up to eight weeks (56 days) of intermittent leave in a 12-month period
  • Job protection under the NJ Family Leave Act
  • Ability to take leave intermittently or continuously
  • Coverage for care of seriously ill child, spouse, parent, or parent-in-law
  • Benefits for bonding with an infant or newly adopted child
  • Leave related to a family member's active military service

Eligibility for New Jersey Family Leave Insurance

You must meet the exact requirements to qualify as a caregiver for NJ Family Leave Insurance benefits.

Age and residency requirements

To qualify for Family Leave Insurance in New Jersey, you must be a worker covered by an FLI plan - either provided by the state or an approved private plan. There are no age requirements for eligibility.

Health and disability requirements

According to the law, no specific health requirements exist for caregivers caring for family members. However, the family member being cared for must suffer from a severe health condition defined by the law for the caregiver to be eligible. Caregivers may need to meet other eligibility criteria, such as income limits and residency requirements.

Financial requirements

To be eligible for the state FLI plan, you must have worked at least 20 weeks and earned a minimum of $240. These conditions must be met to confirm that you are covered under the state's family leave insurance plan. However, it's worth noting that different financial eligibility rules may apply to private plans.
